The French criminal law is characterised by a willingness to prevent recidivism. To give concrete expression to this will, security measures are implemented among which the secure detention. However, the secure detention is not an ordinary measure and gives rises to many debates which, in fact, take up old and recurrent controversies. This measure is based on the assumption that sexual and/or violent criminals show a disease which may suggest a risk of a second offence. System dozoru elektronicznego w Polsce – praktyka stosowania

Napisania niniejszego artykułu podjęto się z uwagi na istniejący od czasu wprowadzenia ustawy o dozorze elektronicznym (2007 r.) problem stosowania kary pozbawienia wolności w systemie dozoru elektronicznego w praktyce. W Polsce z systemu dozoru elektronicznego korzysta obecnie jedynie około 30% całkowitej przewidzianej do odbywania kary w ten sposób liczby skazanych. Pomimo funkcjonowania od 12 lat ustawa wciąż wymaga poprawek. Za podstawowe dwa problemy uznaje się dużą liczbę odrzuconych wniosków o zastosowanie dozoru elektronicznego (w tym również umorzonych postępowań) oraz wnioskowy charakter tego systemu.
